1. Definitions
"We," "us," or "our" refers to The Drinks Agency Limited, the owner of the website.
"You" or "your" refers to the user of our website and services.
"Products" refers to wines, spirits, cigars and smoking accessories, gifts, gift vouchers, and e-vouchers for tastings and events offered for sale on our website.
2. Eligibility
You must be 18 or over to buy alcohol or tobacco products on our website.
By placing an order, you confirm you meet the legal age requirement.
We reserve the right to verify your age and refuse service if we have reason to believe you are underage.
It is an offence for anyone under 18 to buy alcohol or tobacco, or for an adult to buy them on behalf of someone under 18.
3. Ordering
Placing an Order: You can place an order by selecting Products, providing required information, and completing the checkout process.
Order Acceptance: Your order is an offer to purchase. We reserve the right to accept or reject your order at our discretion. Confirmation of receipt of your order does not constitute acceptance. An order is deemed accepted upon dispatch of the Products.
Product Availability: Products are subject to availability. In the event of unavailability, we will either offer a suitable replacement or refund you.
4. Pricing, Payment & Promotions
Prices: Product prices are displayed in British Pounds Sterling (GBP) and include VAT where applicable. UK delivery costs £7.95 per order and is free on orders of £95 or more. Until 31 October 2026, UK delivery is free on all orders. Collection from our Cheltenham shop is free. The delivery charge is always shown at checkout before you pay.
Payment: We accept various payment methods as indicated on our website. Full payment is required before dispatch of Products.
Promotions: We may offer promotions or discount codes from time to time. These may be subject to specific terms and conditions, which will be clearly communicated.
5. Delivery
We aim to dispatch orders within 1 working day. Delivery times are estimates and may vary.
Delivery prices and timings are set out in our Delivery Policy (Shipping & Payment Info).
Deliveries require a signature of someone of legal drinking age. We will not leave alcohol unattended.
You are responsible for providing accurate delivery information. We are not responsible for delays or non-delivery due to incorrect information.
Your order remains our responsibility until it is delivered to you or to someone you have nominated. If it is lost or arrives damaged, contact us and we will replace it or refund you.
6. Returns & Refunds
Cancellation: You have the right to cancel your order without reason within 14 days from the day after you receive the Products ("cooling-off period"). To cancel, you must clearly inform us in writing, and email is fine. You then have a further 14 days to send the Products back. Full details are in our Returns & Refunds Policy.
Exceptions: the right to cancel does not apply to tickets for tastings or events on a specific date, or to personalised or engraved items.
Faulty or Damaged Products: If you receive damaged or incorrect Products, contact us immediately. We will arrange a replacement or refund as appropriate.
Refunds: Refunds will be processed to the original payment method within 14 days of us receiving the Products back, or of you showing proof you have sent them, whichever is sooner. If you cancel your whole order, we also refund the standard delivery charge you paid.
7. Intellectual Property
All content on our website, including text, images, logos, and trademarks, are protected by intellectual property rights. You may not use this content without our express written permission.
8. User Conduct
You agree not to use our website for any unlawful or harmful purposes.
You agree not to upload or transmit any material that is defamatory, offensive, or infringes on the rights of others.
9. Limitation of Liability
To the extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services.
Our total liability for any claim will not exceed the amount you paid for the Products.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.
10. Disclaimer of Warranties
Our website and services are provided "as is" without warranties of any kind. To the extent permitted by law, we disclaim all warranties, express or implied. Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

These Terms are governed by and construed in accordance with the laws of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website. The Terms in force when you place your order apply to that order.
